Everyone, even the most law-abiding driver, has to deal with traffic policemen willy-nilly. How to protect your rights if you think that the inspector's actions are illegal and the punishment is unfair?
Instructions
Step 1
If you do not agree with the actions of the traffic police officer, immediately on the spot reflect your disagreement in the protocol. This is the very first step in asserting your rights. You can also demand to invite a superior traffic police officer. These measures can help resolve the problem locally.
Step 2
If the above measures did not lead to the desired result, file a formal complaint in the established form against the actions of the traffic police. This should be done as follows: indicate in your complaint the full name of the judicial authority you are applying to, its index and address, also give all the basic information about yourself: full name, home address, contact numbers, provide detailed information about those traffic police officers on which you are filing a complaint, namely: name, title, position, sign number, certificate number, company car number, address of residence and place of work. All these data must be found out in advance at the place of the conflict situation. The more detailed the information you collect, the more likely you are to achieve justice for that employee.
Step 3
After setting out the data, write the word “complaint” on the sheet and state the problem situation as clearly and clearly as possible. A complaint is a completely official document, so you need to write concisely, emotionlessly, remaining within the bounds of decency. In no case are offensive expressions addressed to police officers, such as "bribe-taker", "impudent", "scoundrel" and others, otherwise you may be accused of insult and slander.
Step 4
Clearly indicate where you see an infringement of your rights, what actions of the inspector you consider unlawful. Attach copies of documents confirming your innocence: a copy of the protocol, a decision on a fine or on deprivation of rights.
Step 5
Show your complaint to an "independent expert" - some third party disinterested. It's good if he has a law degree.
Step 6
Make sure there are no mistakes in your complaint. A literate person commands respect, and the complaint of an ignoramus is unlikely to be considered with great attention.
Step 7
Take the complaint to the court or send it by registered mail.
