To prevent the occurrence of possible problems associated with incorrect paperwork when selling a car, it is necessary to be guided by the new regulations on the registration of motor vehicles.
Vehicle transfer methods
There are several ways to transfer a vehicle from the owner to its buyer:
1. Registration of the purchase and sale transaction according to the account reference. In this case, the seller and the buyer use the services of an intermediary, which can be a commission shop, which carries out all the paperwork for an additional fee. The inconvenience of this method lies in the need to carry out the procedure for removing the car from the register and registering transit numbers in the store.
2. Execution of a general power of attorney, which is a unilateral transaction, as a result of which the car is owned by the seller until the car is registered in the name of the buyer. A general power of attorney is drawn up by a notary and has a number of disadvantages, both for the seller and for the buyer, for example, it has a certain period of validity, and in some cases can be revoked or canceled. Since the entry into force of the innovations concerning the registration of motor vehicles, the issuance of a general power of attorney in most cases has become impractical.
3. Drawing up a sales contract. The procedure for issuing this document has been greatly simplified with the introduction of a new regulation, which is a great advantage over other methods.
Registration of a sales contract
When drawing up a sales contract, the following rules must be taken into account:
- you can draw up a sales contract in a simple handwritten form; there are no clear requirements for the design of this document; notary certification of the contract is optional;
- the contract of sale must contain the most complete information about the car, confirmed by documents (including data on state registration plates), passport data of the seller and the buyer, the time and place of drawing up the contract, the cost of the car, terms of payment, time and place of transfer of the vehicle;
- in addition, you can draw up an act of acceptance and transfer to the contract, containing a list of items and devices transferred along with the car;
- the contract is drawn up in duplicate, one copy remains with the seller, and the second is transferred to the new owner. At the time of signing the contract, the buyer is obliged to transfer the entire amount specified in the contract to the seller.
After the conclusion and signing of the contract, it is necessary to make changes to the unified database of the MREO traffic police. Renewal is usually done by the new owner. The seller of the car also has the right to apply to the traffic police with an application to terminate the registration of vehicles.
