If your car has been a victim of an accident, then according to the law, the insurance company must pay you money within fifteen working days from the moment you submitted the last document. However, in practice, interaction with policyholders is difficult.
Instructions
Step 1
If you need to learn the insurance payment in the company of the person responsible for the accident, then immediately after the accident you will receive an official decision of the traffic police (court) about the incident. Gather all the necessary paperwork and contact your insurance company. All your relationships with this organization should be formalized exclusively in paper form, you should not enter into correspondence by e-mail, and duplicate telephone conversations by registered mail.
That is, all documents, statements that you make, write, be sure to hand over against signature, register and keep copies of them. Be sure to check the date of acceptance. Otherwise, it will be difficult for you to prove your case in the future.
If it is not possible to hand over all the documents personally, use the mail. Send documents by registered mail with notification, but be sure to make an inventory of all attached certificates, statements, etc.
Step 2
If the company has already received an application from the perpetrator of the accident, duplicate it anyway. If you have any difficulties with completing the application, contact your legal advisor.
Write and register an application for inspection of your car, in which indicate the location of the car, your contact numbers. According to the law, the representatives of the insurer must organize the inspection of the damaged vehicle themselves. It is not your responsibility to deliver the vehicle for damage assessment. This is the responsibility of the insurance companies. But keep the car in the condition in which it appeared as a result of the accident, and do not interfere with the inspection of the equipment by the insurers.
Step 3
If your vehicle has not been inspected by the insurance company within seven business days, contact an independent expert. Then the company will no longer be able to appeal against his assessment. An application for inspection will protect you from additional visits to the company and protect your interests.
Regardless of the results of the examination in the insurance company, you will receive a certificate indicating the documents that you handed over to the company's employees after the accident.
Step 4
Start repairing the car only after the examination has been carried out and the assessment has been made, and the insurance company has issued a written statement (namely, a written statement, not an oral statement), which indicates the exact amount of the payment due to you.
Step 5
If after 15 days the insurer has not given you an answer in the prescribed form, file a claim.
Remember that if the insurer does not fulfill its obligations within the statutory period, you have the right to receive additional compensation as well. Send the legal claim to the insurance company, and its copies to the Union of Auto Insurers and MTIBU. Such actions help to resolve the issue positively.
