You can legally sell a car in two ways: by agreement between the seller and the buyer, and through a thrift store. We will not consider the option of selling and buying a car "by proxy", widespread since Soviet times, since, strictly according to the letter of the law, such a deal is not a sale and purchase.

It is necessary

  • - documents for the car;
  • - car deregistration (optional);
  • - a contract of purchase and sale or services of a commission car dealership.

Instructions

Step 1

The seller of the car himself can remove it from the traffic police register in connection with the sale. But she has the right not to do this. Then he will need to write out a power of attorney for the buyer to deregister his car. Thus, he will have to first remove it from the register on behalf of the seller, then issue it for himself.

If the seller and the buyer live in the same region, even existing license plates can be retained upon deregistration. Otherwise, upon removal, you need to obtain transit numbers for the car and register it with the buyer before the expiration of their validity.

Step 2

Theoretically, the seller and the buyer may not even conclude an agreement, but come to the traffic police together to register the car for the new owner. During the visit, the former owner verbally confirms the sale of the car and demonstrates documents, from which it follows that earlier it belonged to him.

In practice, traffic police officers most often ask the parties to conclude an agreement with each other.

Step 3

It is not at all necessary to certify this document with a notary and pay for his services at a price depending on the amount of the transaction. A simple written form certified by both parties is sufficient.

A typical document of such a plan can be searched on the Internet or you can contact a lawyer for help.

Step 4

When selling a car through a thrift store, you conclude a commission agreement with that and draw up an act of acceptance and transfer. The last document will need to be drawn up when selling directly to the buyer.

If you find someone who wants to buy your car yourself, you can also make a deal through a commission store for a nominal fee (in Moscow in 2010, on average, 1000 rubles).

In this case, the new owner of your car receives a certificate invoice and a copy of the salon license, with which he can go to the traffic police to register the purchase in his own name.

Step 5

If your car was owned for less than three years, after the year in which the transaction took place, you must submit a 3NDFL declaration to the tax office at the place of registration by the end of April. With a transaction amount of up to 125 thousand rubles. inclusively, you do not need to pay tax (and more - only on the part of income that exceeds this amount). But you still have to submit a declaration and an application for a property tax deduction.

When selling a car that has been owned for more than 3 years or longer, you do not have to file a declaration and pay tax, you will be automatically deducted from the entire transaction amount.
