Buying a car is a joyous event for most people. But very often joy gives way to chagrin if the car breaks down every now and then and is at the service station most of the time. In accordance with the laws of the Russian Federation, you can not only exchange a purchase, but also get your money back.
Necessary
- - Statement to the seller;
- - opinion of independent experts;
- - application to the court.
Instructions
Step 1
If your new car does not suit you for numerous reasons, and you have to spend a lot of time on its endless transportation to the service for repair, then you can demand back your money and return the car to the seller. In particular, this is guaranteed by the law on the protection of consumer rights and the Civil Code of the Russian Federation.
Step 2
In accordance with the law, you can exchange goods for a similar or any other with an additional payment, or get your money back. If your car has been at a service station for 30 days in one year, or you have found significant defects within 14 days from the date of purchase, contact the dealer and claim your money back. But this only applies to new products. If you purchased a used car, then you can return your money only within two weeks from the date of purchase if hidden defects are discovered that the seller knew about, but withheld.
Step 3
To prove that there are flaws, invite an independent expert from a licensed service. You will be fully diagnosed and given a written opinion. You will have to pay for this service out of your own pocket, but you will definitely receive all costs back after the trial. You can also demand to pay you for moral damage and for a lot of time spent on proceedings and courts.
Step 4
All this should be done only if the seller refuses to return the money or offers you a new product in exchange for a defective one, and you do not agree to this. If the circumstances have developed in this way, contact the Arbitration Court. Submit your application, attach the opinion of an independent expert. Although by law you are not required to pay for an independent examination, the manufacturer of the goods is obliged to carry out all diagnostics. But practice shows that without the participation of a specialist from an independent expert service and his written opinion, it is almost impossible to prove that the car constantly breaks down through the fault of the manufacturer.
