In 2014 and 2015, cases of cancellation of registration of cars and seizure of license plates, certificates of registration of vehicles (SR CU) and passports of vehicles (PTS), cars imported into the territory of the Russian Federation with the presentation of a certificate (OTTS, SBKTS, Euro certificate), which was subsequently canceled.
It is necessary
- - a letter from the traffic police about the need to return (or seize, destroy, cancel, and so on) PTS, SR vehicle and license plates of the car;
- - vehicle passport;
- - vehicle registration certificate;
- - certificate of conformity (one of the following documents: Certificate of safety of the vehicle structure, Approval of the vehicle type, Certificate of conformity to the Technical Regulations "On the requirements for emissions of harmful (polluting) substances by automobile equipment put into circulation in the Russian Federation" - Certificate " Euro").
Instructions
Step 1
Search for a certificate. On the official website of the Federal Accreditation Service fsa.gov.ru, we are looking for a certificate by number. We go to the specified site, go to the "Registers" section, then "Certificates of conformity", "Unified register of certificates of conformity". We indicate the number of the certificate. Click "Search".
If you do not have a certificate available, you need to find its number in clause 17 of the TCP and follow the procedure, see the previous paragraph.
If you do not have a certificate number in the TCP, do not despair. The search can be carried out according to several criteria:
1. We are looking for the VIN, which is indicated in the "Products" column.
2. We are looking for the applicant, which is indicated in the TCP in column 21 "Name of the owner of the vehicle". In the search, we indicate the applicant in the "Applicant" column.
3. We are looking for the brand, model of the vehicle, which are indicated in the TCP in column 2 "Brand, model of the vehicle". In the search, we indicate the information in the "Products" column.
If you have specified SBKTS or OTTS - you need to go to the website of the Federal Agency for Technical Regulation and Metrology - gost.ru. The procedure is similar to that described for the Rosaccreditation website.
Step 2
Verification of the Certificate. You can always check the status of the found certificate. Green - valid, red - canceled.
If you find two certificates for the same car, one canceled and the other valid - provide information about the current certificate to the traffic police, they will have to restore the vehicle registration (most likely, new PTS, SR TS and state registration plates will be issued) …
Step 3
Detailed study of the reasons for cancellation. Click on the "Number" of your certificate and go to the detailed information about the issued certificate.
As practice shows, the main reason for the revocation of certificates of conformity is the following reason: "Termination of the certificate of conformity, Type of termination: By the decision of the applicant." This means that the certificate was canceled at the request of the organization indicated in column 21 of the TCP, which raises obvious doubts. It seems unbelievable to me that the applicant would put a spoke in his own wheel.
After a detailed study of the certificate of conformity, we get a huge amount of additional information about the car: Applicant - the person who imported the car to Russia, who is the first owner; detailed information about the Certification Body or Testing Laboratory that issued the certificate or SBCTS, its accreditation or information about the revocation of accreditation; as well as detailed information about the car.
Step 4
We are writing a letter to the Certification Body. As the owner of a product that has been certified and whose certificate has been revoked, you have the right to know the reasons for revoking certification. As far as I know, the vast majority of certification bodies that have carried out the revocation of certificates continue to operate. At the same time, some of them are ready to volunteer to help the injured car owners. It is necessary to obtain as much information and documents from the certification body as possible; some certification bodies provide letters in which they call the actions of the traffic police to cancel the registration of cars illegal. We collect all possible documents.
Step 5
We are suing the certification body. One of the ways out of this difficult situation is to try to restore the certificate, because the certificate was most often canceled "by the decision of the applicant". You can file a lawsuit in court for the illegal cancellation of the certificate and for compensation for moral and material damage caused by illegal or erroneous actions of the certification body, which entailed your serious material losses.
The certification body will try to prove that it did not commit illegal or erroneous actions. The likelihood of winning a lawsuit is low, but still there.
Step 6
We are suing the Applicant. If the previous steps did not give you positive results (registration has not been restored), you need to sue the Applicant - in fact, it turns out that he sold you products that do not meet safety requirements - and this is a violation of the law and the chances of winning a lawsuit are high enough.
Step 7
We are suing the traffic police. In fact, suing the traffic police is the "last thing". Having studied a large number of cases on cancellation of registration, I can safely say that representatives of the traffic police act within the framework of the current legislation, but since we no longer have a choice, we must try to challenge the actions of the traffic police, suddenly a mistake was made somewhere. The probability of winning a lawsuit is practically zero …
Step 8
If none of the above steps led us to the desired result, look for people like you who are affected by the cancellation of registration. The number of cancellations is becoming more and more and they are already in the thousands. It is necessary to create a public outcry. Believe me, public opinion will contribute to the settlement of this issue if the scale of the problem is visible.
