The driver's license seized by the traffic police is kept in the case file until the magistrate decides the question of depriving or depriving you of the right to drive a vehicle (TC), and then two scenarios are possible.

Instructions

Step 1

Option one. If the court issued a decision to deprive you of the right to drive a vehicle for a certain period of time, you will be able to pick up your driver's license only after this period has expired. And you need to do this in the traffic police department, whose employees seized your driver's license (VU).

Step 2

In general, the VU should return "automatically" and immediately after the expiration of the period of deprivation, but, of course, the initiative should come from the person concerned, no one will track any terms for you. Therefore, you need to apply for the return of the VU addressed to the head of the specified traffic police department. The application is drawn up in any form (perhaps in the same department you can find a sample application), attach to it the order of the magistrate on deprivation of a driver's license or in the application itself indicate the date of the order and the production number.

Step 3

When you receive a VU after the expiration of the period of deprivation of a driver's license, you do not need to take a qualifying exam, but you will have to go through a medical examination and submit a medical certificate to the traffic police. The absence of a certificate of admission to driving a vehicle is the only reason for refusing to return the vehicle.

Step 4

If, after the issuance of a decision to revoke a driver's license, the court or traffic police officers verbally or in writing demanded that you surrender a temporary permit for the right to drive the vehicle, and this requirement was not fulfilled by you, the period of deprivation is interrupted. This means that the following situation may arise: you applied for the return of the IU after, as it seemed to you, the expiration of the deprivation period. But then it turns out that you have not surrendered a temporary permit (if there is a requirement to do this), and you finally surrender this permit, but you will not receive a VU, because the period of deprivation specified in the court order will only now begin to flow.

Step 5

Another option for the development of events. Based on the results of considering the administrative material on the fact of your violation of the traffic rules of the Russian Federation, the judge comes to the conclusion that you are guilty, but instead of depriving you of your driver's license, he assigns you a lighter punishment - a fine. Very often you can hear the following statement from the judges: "You will receive the certificate when you bring the receipt for payment of the fine."

Step 6

These requirements of the court, of course, are aimed at the speedy execution of judicial acts, which in itself is not bad, but the court no longer has legal grounds to keep a driver's license. The driver's license must be returned to you immediately after the decision to impose an administrative fine is issued, because a fine and deprivation of driving license are two different types of punishment, and only one can be applied.
