The garage cooperative is an association of citizens on a non-profit basis. This is one of the types of consumer cooperatives, which makes it quite easy to solve the issue of storing personal cars.
The Garage Building Cooperative (GSK) is a legal organization whose purpose is to build a garage complex on contributions from citizens - members of the cooperative. There is no separate law that would regulate the activities of the GSK, however, some articles of the Civil Code (for example, Article 116) and the law adopted back in Soviet times "On Cooperation in the USSR" (No. 8998-XI of 1988-26-05)
The source of investment in the construction of the garage complex is the contributions of the shareholders. There can be no less than three members of the cooperative. Decisions on the activities of the organization are made at a general meeting, and each shareholder has equal rights to make every decision. How can we not recall the famous film by Eldar Ryazanov "Garage", after watching which one can understand what a garage cooperative is.
After the completion of construction and the start of operation of the garages, the garage complex will be in common shared ownership, but the car places in it will belong only to those members of GSK who have fully paid the share contributions. The garage cooperative is obliged to pay tax on the property that is on its balance sheet until all garages become the property of the cooperative members, after which the owners will pay the tax.
A garage-building cooperative has the right to engage in entrepreneurial activities, for example, renting out free garages, providing car repair services. Income from these activities is distributed among the shareholders of GSK (clause 5, article 116 of the Civil Code of the Russian Federation).
After the completion of the construction of garages and the full payment by all members of the cooperative of share contributions, the garage cooperative must be transformed into a consumer cooperative for the joint operation of public facilities, or liquidated.
