When buying or selling a car from sellers and buyers, it becomes necessary to draw up a purchase and sale agreement. A number of organizations offer services for the preparation of a contract on a reimbursable basis, which becomes an additional cost item for citizens who sell or buy a car. The law makes specific requirements for documenting the purchase and sale of vehicles, knowing which, you can independently draw up the specified contract.
The contract of purchase and sale of a vehicle is drawn up according to the rules stipulated by paragraph 1 of Chapter 30 of the Civil Code of the Russian Federation and Order of the Ministry of Internal Affairs of Russia dated November 24, 2008 No. 1001 "On the procedure for registering vehicles", and must contain the following conditions.
Date and place (city, town) of drawing up the contract.
The preamble of the contract, which indicates the surname, name, patronymic of the seller and the buyer.
The subject of the contract, that is, the wording: "The Seller undertakes to transfer to the ownership of the Buyer, and the Buyer undertakes to accept and pay for the next vehicle." In this section, you must specify the following information about the vehicle: make, model, modification (type), year of manufacture (year of manufacture), vehicle identification number (VIN), if assigned by the manufacturer, color, serial production number of the chassis (frame), body (cab, stroller, trailer), series, number, date of issue of the vehicle passport and (or) registration document and the name of the organizations that issued them.
The price of the contract (the amount for which the car is sold is indicated in rubles).
Personal data of the parties to the contract (name, year of birth, passport data, place of registration of an individual).
Signatures of the parties.
It is advisable to prepare and print the agreement in advance, before leaving empty columns on those items that are not yet known (date of the agreement, name and details of the second party to the agreement, description of the subject of the agreement, price of the agreement). When making a deal, the missing fields can be filled in by hand.
