In the absence of OSAGO insurance, a fine is imposed both on the driver who forgot the document at home, and on the citizen who did not issue the policy at all. However, in these cases, the situations may be different: for example, you have expired the insurance or did not enter the driver who drives your car into it. And here the traffic police officer must approach the execution of punishment in a differentiated manner. What are the most common situations?

There is no insurance at all or it has expired

For the absence of an OSAGO policy, the guilty person faces a fine of 800 rubles. The same amount will have to be paid to the budget by a driver whose insurance has expired (expired). In addition to the financial "impact", the traffic police inspector has the full right to remove state registration numbers from your car (the ban was introduced from 01.01.2013). After drawing up a fine, withdrawing the employee's numbers, you will have to drive to the nearest office so that you can insure the car. Moreover, this must be done within a day. As a result, your plans will be violated: you will have to spend time buying OSAGO and returning numbers to the traffic police.

The policy is forgotten at home or the driver is not entered

If there is a policy, but for some reason it was not in the car, the guilty person will face an administrative penalty in the form of a fine of 500 rubles (according to the Code of Administrative Offenses, Part 2, Article 12.3). The amount is not large - the question is whether the inspector will wait until you provide him with insurance, or will remove the license plate. There is one more nuance: a traffic accident. If at this unpleasant moment you do not have a policy, and your fault, then the insurance company has the right to claim damages from you in court. But before that, the insurers will be obliged to compensate the victim.

There is also a situation when you urgently need to get behind the wheel of a car, but there is no time to write out insurance. If such a violation is detected, the traffic police inspector will impose a fine of 500 rubles (Code of Administrative Offenses, Part 2, Article 12.37). If the cause cannot be eliminated immediately (for example, a driver entered in the OSAGO policy will appear, or it will be possible to "expand" it with the help of insurers), then an employee of the road department will remove the license plates. Vehicle operation will be prohibited until the reason for the prohibition is eliminated. Be careful when drawing up the protocol: some unscrupulous (or ignorant) traffic police officers may try to issue an insurance forgotten at home as missing at all. Then the difference in the fine will be 300 rubles.
