If you buy a long-coveted motorcycle from your hands, you need to arrange it according to all the rules, paying attention to all the little things. This is especially true in cases when the vehicle goes without documents, which in some cases may complicate registration a little.
Instructions
Step 1
The first step is to sign an agreement with the seller, in accordance with the Civil Code of the Russian Federation. It doesn't matter what form this document is, handwritten or printed, it will certify your purchase. The contract must have the date and signature of the seller, as well as, preferably, a witness, which may even be a neighbor. In the contract, it is necessary to describe the purchased motorcycle in as much detail as possible (color, engine number, etc.)
Step 2
In addition to the contract, you can draw up a receipt for the sale and purchase of a vehicle and the seller's receipt of a certain amount of money. In any case, the document should indicate that the documents for the motorcycle were lost prior to the execution of this transaction, so that there will be no problems in the future. In fact, you are already the owner of the motorcycle, because it is not necessary to formalize the transaction by a notary (Article 161 of the Civil Code of the Russian Federation).
Step 3
After signing all the necessary papers, you must write an application to the traffic police for the issuance of a vehicle passport. Even if there are no documents for the motorcycle, you are obliged to issue a PTS, in accordance with the laws of the Russian Federation.
Step 4
If you are denied a passport for a vehicle, you should get this refusal in writing. With copies of the contract and receipt, as well as with a refusal, you need to go to court. After writing a statement of claim about the infringement of your constitutional rights to freedom of movement, you will need to pay a small fee and wait for a court decision. Usually it is in favor of the plaintiff.
