A temporary certificate is issued as a result of an administrative offense and deprivation of the right to drive a car. This certificate can be issued for a period determined by the moment of entry into force of a court decision on an administrative offense. The legislation establishes the maximum period for issuing a temporary certificate - no more than two months. The difficulty lies in the fact that sometimes the period of validity of the temporary certificate ends before the order can be issued on the case. In some cases, you can extend its validity period.
Instructions
Step 1
As a result of a violation of the norms of administrative law in another region or region, but the case materials were not timely received at the judicial department for the registration of the car or the place of residence of the offender.
A temporary license can be extended at the traffic police by presenting a report on the violation and writing a free-form application at the place of residence. According to the Directives of the DOBDD Ministry of Internal Affairs of the Russian Federation of 12/21/07, No. 13 / 9–241, a refusal by the traffic police will not be lawful.
The same instruction also states that if within five months the materials of the case on the commission of the violation have not been received by the authorized person, then the driver's license and all the materials of the case can rightfully be considered lost.
Step 2
If the materials of the case are pending before the magistrate and the statute of limitations for civil liability has not expired, then after the two-month period of validity, the magistrate shall extend the temporary certificate.
Step 3
If a citizen appeals against the decision within ten days from the date of its issuance, which deprives him of the right to drive, then until he receives a court decision, the decision will not come into force. In this case, the temporary permit may be renewed by a federal judge in a city or district court.
Step 4
After the expiration of the two-month period, the official extends the period of validity of the temporary permit by one month for each application. But in the case of repeated committing of an administrative violation after the issuance of a temporary certificate, the issuance of a new temporary permit is not allowed, and a mark is made in the existing certificate that a second protocol has been drawn up.
