Part 1 of Article 12.3 of the Code of Administrative Offenses of the Russian Federation for driving a vehicle without a driver's license provides for a fine of one hundred rubles or a verbal warning. It would seem that the fine is small and you can drive without worrying about the documents left behind. However, there is one "but".
According to article 27.13 of the Code of Administrative Offenses of the Russian Federation, a traffic police officer is obliged to detain a vehicle until the reason for its detention is eliminated. Detention of a car means its evacuation and placement in an impound parking lot. This can lead to a lot of additional problems, such as lengthy searches in specialized parking lots in the city and possible external damage to your car that occurred during transportation. In addition, you will have to pay for the services of a tow truck and a parking lot in an amount several times higher than the amount of the fine itself.
How to solve the problem in a legal way?
The law does not clearly specify the time to eliminate the reason for the detention. Therefore, you need to ask relatives or friends to bring documents or go for them yourself. To do this, in the protocol drawn up by the traffic police officer, in the “explanations” paragraph, you must write the following text: “I, full name, left my driver's license at home at the address (write down the address of residence), I am ready to bring them within two hours. I ask permission to leave your car at the current address (indicate the address) for a period of two hours."
In the explanation, be sure to indicate the real time for which you can bring your license, in case of delay, your car will still be evacuated.
If the car is parked in compliance with the rules of the road, then the traffic police are obliged to leave the car until the driver provides his license. If a parked car interferes with the movement of vehicles, then you must ask the permission of the traffic police to move the car to the parking lot. In this case, in your explanations, you write the address of the parking lot where the car will be parked.
After the documents are provided to the traffic police, the reason for the detention is considered eliminated.
