It is possible to correctly draw up documents on an accident without the participation of specially authorized police officers. The simplified settlement of such situations has many positive aspects: saving time both in the case of waiting for traffic police officers or for trips to the analysis group, and for issuing all the necessary certificates.
Instructions
Step 1
You can draw up documents on an accident yourself without the participation of traffic police officers. However, the following circumstances must be observed:
- damage from a road traffic accident was caused only to property;
- only 2 vehicles were involved in the accident;
- the civil liability of car owners involved in an accident is insured in accordance with the Federal Law "On Compulsory Civil Liability Insurance of Vehicle Owners" (the law on OSAGO);
- the participants in the accident have no disagreements regarding the circumstances of causing harm in connection with damage to property and determining the nature and list of visible damage to vehicles;
- all the circumstances of causing harm, the nature and list of damage to vehicles are recorded in the traffic accident notifications, the forms of which are filled in by the drivers of the vehicles involved in the accident.
Step 2
The accident notification form is filled in by the drivers of both vehicles. They also certify with their signatures the circumstances of the damage, the scheme of the traffic accident and the nature and list of visible damage.
Then the completed road accident notification form, together with the victim's statement of insurance payment to determine the amount of losses to be reimbursed, is sent to the insurance company, where the culprit of the road accident is insured under OSAGO. You can also contact the victim's insurance company. Remember that you cannot contact both insurance companies at the same time.
It is important to take into account that when registering an accident without the participation of traffic police officers, the insurance company more strictly checks the documents, examines the circumstances of the accident and the correctness of the notification of the accident. In this case, the amount of the insurance payment to the victim cannot exceed 25 thousand rubles.
Step 3
When you independently draw up documents on an accident, you must be sure that all documents of the second participant in an accident are not fake and are drawn up correctly: OSAGO policies (documents are valid both for insurance terms and for the period of validity, the driver is entered into the policy and the money for them entered the company- insurer), documents for the car (registration certificate, passport, driving license).
Please note: if you yourself have drawn up all the documents about the accident, but later you had to go to court - you do not have the most significant document in your hands - a traffic police certificate, confirming the very fact of a road traffic accident.
