Selling a car under a general power of attorney entails many negative consequences for both the seller and the buyer. To avoid various legal incidents, draw up the purchase and sale transaction properly: draw up a vehicle sale and purchase agreement.

Step 1
What inconveniences arise when the seller issues a general power of attorney? First, the burden of paying the vehicle tax is still borne by the owner of the car, not the new owner acting by proxy. Secondly, responsibility for causing harm by a source of increased danger (in the event of an accident) is borne by the same owner. Thirdly, in the event of the death of the seller, the power of attorney is no longer valid, and the “general” owner may be left without a car. On the other hand, in the event of the death of the trustee, the owner's heirs will not be able to claim the right to own the vehicle for the same reason - the power of attorney expires.
Step 2
A contract for the sale and purchase of a vehicle can be concluded for a small fee in an organization that provides intermediary services to the population. Such firms are usually located near the registration points of the traffic police. Or you can draw up a contract yourself.
Step 3
In the contract, indicate the date and place of its conclusion (meaning the locality, and not your specific location - "at the third window of the traffic police registration hall", etc.) In the preamble of the contract, indicate the name of the seller and the buyer, date of birth, passport data and registration addresses
Step 4
Enter into the contract data on the subject of purchase and sale: car make and model, vehicle type, identification number, engine model and number, year of manufacture and color. Indicate the details of the vehicle's passport - the series and number of the vehicle title, by whom and when it was issued
Step 5
Determine the cost of the vehicle, the payment procedure and the time for the transfer of the vehicle. Indicate the moment of transfer of risks and ownership of the vehicle from the seller to the buyer. In the final provisions, add a clause stating that the buyer is familiar with the technical condition of the vehicle being sold. Indicate the number of drawn up copies of the contract, insert the details of the seller and the buyer
Step 6
Draw up an act of acceptance and transfer of the vehicle to the contract. The preamble of the act is the same as in the treaty. In the form of a plate, indicate the technical characteristics of the car in accordance with paragraphs. 1-9 PTS. Indicate that all necessary documents and accessories related to the vehicle have been handed over to the purchaser. You do not need to draw up a receipt for receipt of funds if you write about it in the act.
